Supreme audit bodies of EAEU member states had earlier flagged a conflict in how import duty receipts are credited and shared in Kazakhstan; such joint reviews are conducted annually under paragraph 53 of Annex 5 to the Union Treaty. Source: Eurasian Economic Commission (EEC).
On 29 May in Astana, the Supreme Eurasian Economic Council signed a protocol amending that annex. Import duties paid by Kazakh companies on goods brought in under subsoil-use contracts and production-sharing agreements concluded before 1 July 2010 will no longer be divided among Union member states.
EEC Minister for Economy and Financial Policy Bakyt Sultanov explained that these amounts are reimbursed to subsoil users from Kazakhstan's budget; without the amendment, the budget would face double spending — compensating investors while transferring more than 93% of the amount to other EAEU partners. The rule applies to relations arising from 1 November 2014.
